Facts last verified on 3 November 2026
- The Supreme Court of WA says a grant is usually needed if your loved one had assets in WA solely in their name, or owned real estate as tenants in common. It may not be needed for jointly held real estate or bank accounts (Before applying).
- The application is a motion, an affidavit and a statement of assets and liabilities, filed with the original will and death certificate. Leave the will as it is, with no staples, pins or clips. The court also offers a Probate Online Application for applications that are not complex.
- You can file in person or by post, and the court recommends registered post. It aims to process applications within four weeks, though complex ones can take longer (Filing with the court).
- From 1 July 2026 the fee to file an application for a grant is A$418.00 (probate forms and fees). Fees change each 1 July, so check the court's current page before filing.
- Landgate's guides say how the land is held decides the next step: a survivorship application for joint tenants, or a transmission application after the grant for land held solely or as tenants in common (Landgate DEC-01).
- A vehicle licence is transferred with a Declaration of Deceased Estate (form E172) at a service centre or regional agent, or by post (Department of Transport and Major Infrastructure).

Time limits: flags, not calculators
Section 7(2) of the Family Provision Act 1972 (WA) says a family provision application is not heard unless it is made within six months from the date the administrator becomes entitled to administer the estate in WA, unless the court gives leave to file out of time. Legal Aid WA describes the limit as six months from the grant. The add-on shows both as a flag with its source, not a calculated deadline. For notices to creditors, section 63 of the Trustees Act 1962 (WA) lets a personal representative advertise for claims, allowing not less than one month; it does not apply to family provision claims (last verified 3 November 2026). Please confirm your deadlines with a solicitor before distributing anything.
Questions
Is the WA Add-on part of the Complete Pack?
No. It is a separate product. The Complete Pack contains the Workbook, the Letter Pack and the Beneficiary Pack.
Do I need the Workbook as well?
The add-on works on its own, but it is designed to sit beside the Workbook, which holds the main asset, debt and contact records for the estate.
Does it tell me what the law requires?
No. It is a record-keeping template with links to the official Western Australian pages and the date we checked each one. For advice about your situation, speak to a Western Australian solicitor or the Public Trustee.
